Terms of Service

These Terms of Service (“Terms”) govern your use of Uplodeo (“Uplodeo,” “we,” “our,” or “us”), the service available at uplodeo.com. By creating an account or uploading content you agree to these Terms. If you do not agree, do not use the service.

1. Who can use Uplodeo

You must be at least 13 years old to use Uplodeo. By creating a host account you represent that you are at least 18, or that you have the permission of a parent or legal guardian if you are between 13 and 17.

Uplodeo has two types of users:

  • Hosts — people who create an account, set up photo collections, and manage uploads. Hosts pay for plans and are responsible for their collections.
  • Guests — people who scan a QR code or follow a link to upload photos. Guests do not create an account. Their participation is anonymous and session-scoped.

2. Host accounts

When you create an account you agree to provide accurate information and to keep your credentials secure. You are responsible for all activity that occurs under your account.

You may not share your account credentials, create accounts through automated means, or impersonate another person or entity.

Uplodeo uses email-based authentication (magic links, email/password, or Google sign-in). We do not store passwords in plain text.

3. How the service works

Uplodeo lets you create a private photo and video collection (“Collection”), generate a shareable QR code or link, and collect media from guests — without requiring guests to sign up.

Each Collection has an upload limit, an expiry window, and optional per-camera controls set by the plan you purchase. When a Collection expires, guests can no longer upload. The Collection and its media remain accessible to the host for review and export during the applicable retention period.

Uploaded files are stored privately. Guests cannot access other guests’ uploads. The host reviews and approves uploads before they appear in any shared gallery view.

4. Acceptable use

You agree not to use Uplodeo to upload, share, or solicit content that:

  • Is illegal, harmful, threatening, abusive, harassing, defamatory, or obscene
  • Depicts or encourages violence, self-harm, or exploitation of minors
  • Contains child sexual abuse material (CSAM) — we are required by law to report such content to the NCMEC
  • Infringes any copyright, trademark, or other intellectual property right
  • Contains malware, viruses, or any code intended to disrupt the service
  • Violates the privacy of another person (e.g., non-consensual intimate images)

As a host, you are responsible for the content uploaded to your Collections by your guests. You must not use Uplodeo in a way that facilitates illegal data collection, surveillance, or harassment of guests.

We may suspend or terminate accounts that violate these rules without prior notice.

5. Content ownership and license

Your content is yours. Uploading photos or videos to Uplodeo does not transfer ownership to us. You (or the guest who uploaded the file) retain all copyright in that content.

By uploading content you grant Uplodeo a limited, non-exclusive, worldwide, royalty-free license to store, process, and display that content solely to provide the service to you. We do not use your uploaded photos or videos to train AI models, sell to third parties, or display them publicly without your instruction.

Hosts grant Uplodeo the right to generate thumbnail previews and watermarked export files as part of service delivery.

Guests grant the host of the Collection they upload to a license to view, moderate, export, and keep copies of their uploads, consistent with the purpose of the Collection.

6. Plans, payments, and refunds

Uplodeo offers a free plan and several paid plans. Plan details — including upload limits, camera counts, active days, and video permissions — are described on our pricing page and at the time of purchase.

Payments are processed by Stripe. By purchasing a plan you agree to Stripe’s Terms of Service. Uplodeo does not store your card details.

All sales are final. We do not offer refunds except where required by applicable law. If you experience a technical failure that prevents you from using a paid plan you purchased (e.g., the service was unavailable for the entire active window), contact us at legal@uplodeo.com and we will review your request.

Capacity add-ons (extra uploads or extra days) are charged at the time of purchase and are non-refundable.

7. Free plan watermarks

Collections created on the Free plan include an Uplodeo watermark on exported files. This watermark is applied at export time and does not alter the original uploaded files, which remain stored without modification.

Upgrading to a paid plan removes the watermark from future exports of that Collection.

8. Collection expiry and data retention

Each Collection becomes read-only (guests can no longer upload) when its active window expires. Hosts retain access to review and export their content after expiry.

We retain Collection data (uploads, metadata, guest session records) for a grace period after expiry to give hosts time to export. After the grace period, data may be permanently deleted. We will make reasonable efforts to notify hosts before deletion.

You can delete a Collection and its associated uploads at any time from your dashboard. Deletion is permanent and cannot be undone.

9. Intellectual property — Uplodeo’s property

The Uplodeo name, logo, wordmark, and the software underlying the service are owned by Uplodeo and protected by copyright, trademark, and other laws. These Terms do not grant you any right to use our trademarks or brand assets.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the service will be uninterrupted, error-free, or free of viruses. We do not warrant that uploaded files will never be lost, corrupted, or accidentally deleted.

Back up your content. We encourage you to download and keep copies of your important photos and videos. Uplodeo is not a permanent archive service.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, UPLODEO AND ITS OFFICERS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE AMOUNT YOU PAID TO UPLODEO IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR USD $50, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify and hold Uplodeo harmless from any claim, demand, loss, or damage — including reasonable legal fees — arising from: (a) your use of the service; (b) content you or your guests upload; (c) your violation of these Terms; or (d) your violation of any third-party right, including copyright or privacy rights.

13. Copyright and DMCA

We respect intellectual property rights. If you believe content on Uplodeo infringes your copyright, please send a DMCA notice to legal@uplodeo.com with: (1) identification of the copyrighted work; (2) identification of the allegedly infringing material and its location on our service; (3) your contact information; (4) a statement of good faith belief; and (5) a statement under penalty of perjury that the information is accurate and you are the copyright owner or authorized to act on their behalf.

We will remove infringing content promptly upon receipt of a valid notice and may terminate the accounts of repeat infringers.

14. Changes to these Terms

We may update these Terms from time to time. When we make material changes we will update the “Last updated” date at the top of this page and, where practical, notify active hosts by email. Your continued use of the service after changes take effect constitutes acceptance of the revised Terms.

15. Governing law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in California, and you consent to personal jurisdiction in those courts.
